  1. Contract scope

    YOU-FOUND-IT is a service offered and maintained by POLO4 AG to you. By using the YOU-FOUND-IT services and webpage, you must accept these GTC's (which may be updated from time to time) and you are agreeing to the terms and conditions that appear below, whether or not you register as a user.

  2. Product offerings

    Any details that the customer receives about the goods and/or services during the order process or registration service are not binding. This includes modifications to product design and technology or changes in service which improve the product's/services functionality, as well as errors in the product/service description, illustrations, and pricing details.

  3. Intellectual property

    YOU-FOUND-IT owns the rights to every design, text, and graph on its web sites. Making a copy or any kind of reproduction of either the entire web site or parts thereof is strictly prohibited. The YOU-FOUND-IT name, all page headers, navigation bars, graphs, and display symbols are registered trademarks, brands, or protected brands of YOU-FOUND-IT. All other trademarks product or company names or logos which are displayed on the web site are the sole property of their legitimate owner. YOU-FOUND-IT retains the property rights and copyrights to all illustrations, drawings, calculations, and other documents. Before transferring such items to a third party, the customer must request YOU-FOUND-IT explicit agreement in writing.

  4. Data protection

    YOU-FOUND-IT ensures adherence to the regulations of the Swiss data protection laws and the relevant legal standards when inquiring, administering, and using person-related data. Customer related data gathered for order processing is used solely for internal market research purposes. Transfer of such data to third party partner organizations will occur only when absolutely necessary for proper delivery of services (e.g., for order processing). The customer hereby declares himself in agreement with said use of his personal data.

  5. LIMITATION OF LIABILITY AND DISCLAIMER for the use of YOU-FOUND-IT

    The "YOU-FOUND-IT" service is designed as a matching system that will simplify the process by which a finder of lost property can contact the owner and make arrangements with the customer for the return of that property. However, the use of the service is beyond the control of YOU-FOUND-IT who cannot therefore offer any guarantee that YOU-FOUND-IT property will be returned to its owner. YOU-FOUND-IT cannot enter into or be responsible for any arrangements for the return of any property.

    YOU-FOUND-IT will not be liable for any damages (including without limitation, damages for loss of profits) arising in contract, tort or otherwise from your use or inability to use the website or any content or from any action taken (or refrained from being taken) as a result of using the website or any content. The website contains links to other World Wide Web sites, either directly or through frames and, where possible, we will make clear where such links are being made. Those websites are provided by independent third parties and YOU-FOUND-IT is not responsible for their availability, content or service. YOU-FOUND-IT makes no warranty that the website is free from infection by viruses or anything else that has destructive or contaminating properties.

    YOU-FOUND-IT will make its best efforts to ensure that its server is always available for the transmission of emails, the maintenance of its databases'security and the overall operation of the website. However, any failure of the server to provide these services is beyond YOU-FOUND-IT's control and the company cannot therefore be held liable for any failure or disruption to the service.

    YOU-FOUND-IT will send a notification by email to the owner of the YOU-FOUND-IT email address(es) whenever a message arrives on its servers addressed to the YOU-FOUND-IT email address(es) registered to the owner. Our servers are programmed to execute these notifications at least every 30 minutes. YOU-FOUND-IT doesn't warranty that the message will reach the owner within 30 minutes or that it will reach the owner within any guaranteed period.

    SMS messaging (if offered) is handled by third parties and YOU-FOUND-IT sends an electronic message to a SMS service provider which is transmitted by them to the user's mobile phone. YOU-FOUND-IT systems assumes no liability for failure of third parties to forward the SMS text message to the user YOU-FOUND-IT also will make its best efforts to prevent breaches of security caused by 'hacking' but does not warrant that the system is impregnable to such attack and will not be liable for any consequences of such an attack.In all circumstances the total liability of YOU-FOUND-IT(or POLO4) is restricted to refund of the cost of products or service purchased from You-FOUND-IT. No other direct or indirect liability is assumed or implied.

  6. Legal jurisdiction and applicable law

    These terms and conditions (GTC) and any contracts entered into under this GTC are subject to Swiss law excluding UN purchase rights (CISG). Legal jurisdiction is Zürich / Switzerland.

  7. Concluding requirements

    Sales of YOU-FOUND-IT products and service which are specified in any printed or online form or the online shop are covered exclusively by the version of the general terms and conditions (GTC) that is valid at the point in time the contract is entered into. These terms and conditions (GTC) are particularly valid where they differ from the customer's terms and conditions. Should individual requirements be or become invalid, this has no impact on the legal applicability of the remaining terms and conditions in this GTC. In general, YOU-FOUND-IT reserves the right to make changes at any time to these general terms and conditions (GTC).
